“Chemical Valley” — Why Asbestos Exposure Was So Heavy

The stretch of the Kanawha River from Charleston to Institute contained one of the world’s most concentrated industrial chemical manufacturing corridors. Chemical manufacturing requires sustained very-high-temperature reactions, distillation columns, heat exchangers, reactors, and miles of insulated pipe. Until the mid-1970s, all of this equipment was insulated with asbestos products.

West Virginia Asbestos Regulations

The West Virginia Department of Environmental Protection (WV DEP) administers asbestos regulations under WV Code §§ 22-5-1 et seq. and the West Virginia Air Quality Standards Rule:

  • Contractor licensing: WV requires state contractor certification for asbestos abatement. Workers must hold WV asbestos worker certifications.
  • NESHAP compliance: WV DEP enforces federal NESHAP standards and requires 10-working-day notification before demolition or renovation projects above NESHAP thresholds.
  • Chemical Valley context: Many former chemical plant sites in the Kanawha Valley are undergoing brownfield remediation. Asbestos in process equipment and building materials is a documented component of remediation at former Union Carbide, Monsanto, and FMC sites.

West Virginia Statute of Limitations: 2 Years

West Virginia provides 2 years from the date of diagnosis to file an asbestos personal injury claim under WV Code §55-2-12.
