Pennsylvania's Most Exposed Workers

  • Steelworkers — Bethlehem Steel and U.S. Steel employees worked with asbestos-insulated furnaces, ladles, and piping throughout the blast furnace and rolling mill operations. Maintenance trades (boilermakers, pipefitters, insulators) had the most concentrated exposure during plant maintenance shutdowns.
  • Shipyard workers (Philadelphia) — The Philadelphia Naval Shipyard employed thousands of tradespeople building and repairing Navy battleships, carriers, and destroyers. Insulators, pipefitters, and boilermakers in the ship's engine and boiler rooms faced the highest fiber concentrations.
  • Railroad workers — Pennsylvania and Reading railroad employees in locomotive shops and roundhouses worked on steam engines with asbestos-insulated boilers, pipe fittings, and brake systems.
  • Electrical workers — Westinghouse Electric employees who wound, installed, and maintained electrical equipment using asbestos-insulated wire and components throughout Pittsburgh-area plants.
  • Construction trades — Pennsylvania's massive building boom from the 1950s through 1970s employed plasterers, drywall tapers, and tile setters who worked with asbestos-containing materials throughout the state.

Pennsylvania Asbestos Regulations

The Pennsylvania Department of Environmental Protection (PA DEP) regulates asbestos under the Pennsylvania Air Pollution Control Act and the Clean Streams Law. Key requirements:

  • Pennsylvania Asbestos Occupations Accreditation and Certification Act (PAAOCA): Requires state certification for inspectors, project designers, project monitors, and abatement contractors/workers
  • Pre-demolition/pre-renovation inspections: Required for all commercial, industrial, and public buildings before demolition or major renovation
  • Notification: DEP and the local Air Quality Program must receive written notification at least 10 working days before abatement begins
  • Disposal: Asbestos waste must be disposed of at a PA-permitted landfill; double-bagged in 6-mil poly bags labeled per EPA standards

Pennsylvania has one of the more comprehensive state asbestos programs. Certification lookup: dep.pa.gov — Environmental ePermitting / Asbestos Certification.

Pennsylvania Asbestos Litigation

Pennsylvania has a significant asbestos litigation history due to its steel and industrial base. Key facts:

  • Statute of Limitations: 2 years from diagnosis (42 Pa. C.S. §5524)
  • Wrongful death: 2 years from death
  • Philadelphia Court of Common Pleas handles a high volume of asbestos cases; the Complex Litigation Center manages mass tort coordination
  • Bethlehem Steel Trust: Bethlehem Steel declared bankruptcy in 2001; an asbestos-related trust was established as part of the bankruptcy proceedings and continues to pay claims
  • U.S. Steel: Continues to defend and settle asbestos claims related to Pittsburgh-area operations
  • FELA claims: Railroad workers have rights under the Federal Employers Liability Act (FELA), which has a 3-year SOL from the date the worker knew or should have known of the asbestos-related disease
